UK Investigation into Helicopter Deal May Follow Italian Ruling

Author headshot image Posted by , Partner

At the beginning of last week, it was reported that UK authorities were waiting on the results of a trial in Italy, before considering whether to launch a criminal investigation against AgustaWestland, whose factory is based in Yeovil.

Four years ago, AgustaWestland were handed a $560 million deal to supply 12 helicopters to the Indian air force; however at the beginning of this year, the Indian government cancelled the contract, amid bribery allegations.

During the hearing, which has taken place in Italy, two former chief executives of AgustWestland denied any wrongdoing on their behalf, and the behalf of the company; however, despite denying the allegations, India has been awarded $310 million in bank guarantees.

Reports at the beginning of the week suggested that UK authorities were watching the case with interest, to see if any evidence which came to light during the Italian trial, warranted an investigation in the UK – with AgustaWestland being subject to the UK’s Bribery Act.

Whilst it is still unclear whether UK authorities will conduct their own investigation, for those businesses or individuals who find themselves facing allegations relating to bribery offences, our corporate and commercial solicitors in London may be able to assist.
