Successful cerebral palsy claim against London hospital: St George’s University Hospitals NHS Foundation Trust

A young boy has been awarded substantial multi-million pound damages following the negligent care afforded to his mother during her pregnancy.

The claimant’s mother’s first pregnancy was complicated by shoulder dystocia and she should have been advised about the risks of complications in any future delivery; the hospital however failed to do so. Had proper advice and counselling been given the claimant’s mother would have undergone an early elective caesarean section which would have avoided the claimant suffering a severe brain injury.

As a result of the damages received the claimant will now be able to purchase specially adapted accommodation, an adapted vehicle, have 24 hour care and access to bespoke private therapies. This will go a long way to give a child, who is non-verbal, requires wheelchair use, is incontinent and needs 24 hour 1:1 care to have the best quality of life he can enjoy.
