Each case is different and it isn’t possible to give exact time frames from the outset. The length of the case will depend on the complexity of the investigation required, the number of independent medical experts involved, whether meetings with a barrister are required and how long the Defendant takes to respond to the allegations made. We will keep you fully informed of the progress in your case and the likely overall timescales involved.

Cases can be funded in a variety of ways, the most common now is by a “no win, no fee” agreement, otherwise known as a conditional fee agreement. This provides reassurance to our clients that if they are unsuccessful in their case they will not be liable for any legal costs at all. In cases for children who have suffered a neurological injury up to 6 weeks of age, legal aid is still available via the Legal Aid Agency, Withy King hold a franchise from the Agency to undertake legal aid work. Some clients hold the benefit of legal expenses insurance, which will often fund the costs of investigating and litigating a claim.
