Nicola has been a member of our dispute resolution team for over 10 years advising clients across all sectors on a wide range of commercial disputes.

Nicola’s typical instructions relate to professional negligence claims, contractual disputes, post-employment restraint of trade, boardroom and shareholder disputes and insolvency related matters.  She is regularly instructed by insolvency practitioners, financial advisers, technology and manufacturing businesses as well as individuals and SMEs.

In addition, Nicola also advises adult social care providers on contentious and regulatory issues.  This includes challenging CQC inspections and decisions as well as providing troubleshooting and crisis management advice.

• acting for a firm of accountants in relation to a professional negligence claim against its IT provider following a data breach which resulted in substantial ransom payments to the cyber criminals to release and de-crypt their data;
• acting for an individual in relation to the under-settlement of their claim by former solicitors as part of a group action arising from the failed purchase of overseas property;
• acting for a property developer in a professional negligence matter against a surveyor for failing to fully identify the presence of asbestos within a building during pre-purchase enquiries;
• acting on a shareholder dispute / unfair prejudice claim relating to a chain of pubs;
• acting for a sports coach in connection with allegations of safeguarding breaches by their regulatory body;
• regularly acting for a national mortgage broker in connection with restraint of trade claims against former employees;
• acting for a social care provider against a health and safety consultant in connection with negligent advice;
• advising insolvency practitioners in relation to claims within insolvency procedures such as misfeasance claims and antecedent transaction claims against former directors;
• advising a technology start-up on the unlawful termination of a joint venture agreement by an international app provider;
• advising an international manufacturing client in connection with a payment dispute arising out of a supply chain agreement with a car manufacturing giant;
• advising directors on their duties in anticipation of insolvency, including the use and application of Covid-19 bounce-back loans and grants;
• acting for a property developer in a £7m dispute with a debt platform lender arising from the impact of the Covid-19 pandemic on the development;
• acting for a private school in a misselling claim against an energy broker;
