Royds Withy King Birth Injury Client

A child who has been injured has until their 21st birthday in which to make a claim for compensation. If the injured person lacks capacity to bring a case themselves, then there will be no limitation date in bringing forward their case.

The specialist team will always strive to carefully plan a case so that it progresses as swiftly as possible but a lot will depend on the complexity of the claim and how long the Defendant takes to respond.  On average it takes 2 – 3 years to establish liability in a birth injury case.

Brain injuries, especially birth injuries, are usually catastrophic in their nature, demanding a high level of care, equipment and accommodation needs. In a cerebral play case we usually seek damages in their millions to cover the extensive costs of commercial care teams, case manager, deputy, new cars, adapted property, therapies and medical treatments.

Legal Aid is still available to those who have suffered a brain injury prior, during or within the first six weeks of life. Withy King hold a Legal Aid franchise for clinical negligence services and will make the Legal Aid application on your behalf.
