Transferring of confidential client data justified an employee’s dismissal

RWK Goodman advised the company on the investigation process, which included checking the employee’s use of the company’s IT systems, being mindful of data protection legislation.  We advised the company on the subsequent disciplinary process, which culminated in the employee’s dismissal for gross misconduct.   The employee brought proceedings for unfair dismissal and breach of contract in the Employment Tribunal.  The claims were successfully defended by the company.  And in addition, the employee delayed setting up his own competing business, owing to the robust approach adopted by RWK Goodman.  Overall, an extremely successful outcome that protected the company’s business including its client base and commercially sensitive information.
