Industrial Diseases Team secures £160,000 for carpenter with mesothelioma

Posted by , Associate

Mr Hawksworth instructed Royds Withy King following his diagnosis with malignant mesothelioma.

Mr Hawksworth had worked for Sidney Brown (Plasterers – Worksop) Limited as a carpenter in the late 1950s to the late 1970s. He had been exposed to asbestos through the construction of corrugated asbestos cement buildings, primarily farm buildings where he used a handsaw to cut the corners off the cement asbestos sheets.

Mr Hawksworth was widowed with no other dependents, therefore needed a settlement in his lifetime.

While the insurers for Sidney Brown (Plasterers-Worksop) Limited agreed to make an interim payment to Mr Hawksworth, they would not concede liability for his claim.

Royds Withy King issued proceedings in Mr Hawksworth’s case and we’re able to obtain a formal admission of liability. Royds Withy King were able to settle the claim for over £160,000 within four months of first being instructed, having first secured a large sum of benefits and an interim payment of £50,000.

Mr Hawksworth’s daughter said “When Dad was diagnosed with mesothelioma he was advised by the hospital to make a compensation claim. He was reluctant at first as he was nervous of the legal work involved. However, he knew that his one wish was to remain in his own home for as long as possible and compensation might make this possible. Dad needn’t have worried. Thanks to Rachel James at Royds Withy King, the claim was dealt with extremely efficiently and was concluded swiftly in time for Dad to benefit from it. Rachel dealt with both Dad and me with compassion and care at all times. I am extremely grateful to her that as a result of the claim Dad was able to afford care at home right until the end of his life. I wouldn’t hesitate to recommend Rachel to anyone facing a similar situation.”
