Implant incorrectly placed

Mr S consulted his dentist about improving the cosmetic appearance of his teeth. He was offered an implant, which his dentist fitted. Unfortunately the implant was placed at an angle sticking out at the side of the gum near to Mr S’s tongue. Despite attempts by the dentist to put matters right, problems persisted and ultimately Mr S required the implant to be removed and replaced.

Simon Elliman, partner in our Clinical Negligence team with a particular interest in dental claims acted for Mr S and obtained damages for him in the sum of £17,000. The dentist was investigated and reprimanded by the General Dental Council.

Simon comments: “Mr S approached the Dental Complaints Service and the General Dental Council as well as Royds Withy King, and it was very helpful to have input from their investigations as well as our own. The dentist in this case was determined not to pay out anything initially, but our thorough approach ensured proper compensation in the end.”
