Defending a claim brought by mother’s carer
James* and Kristina were beneficiaries of their late mother’s estate. They were facing a claim from their late mother’s carer, Isobel, that she should be entitled to a share of their mother’s estate too.
Isobel claimed that she had provided nursing care for their mother relying on a promise from the mother that Isobel would benefit from her estate on her death.
We proved that not only had there been no clear promise made to Isobel, but also that Isobel had not suffered any disadvantage in these circumstances.
Isobel withdrew her action and James and Kristina were able to receive their full share of their mother’s estate.
