Clear Definition of “Financial Needs” Required

There has been significant confusion in relation to how one person should be required to meet the other’s financial needs after a relationship has broken down; whilst there have also been considerable regional variations.

However, the Ministry of Justice have suggested that the confusion surrounds the meaning of “needs” and the extent to which one spouse should be required to meet the other’s needs and for how long.

As such, the Ministry of Justice have called on the Family Justice Council to put forward guidance which not only defines and explains the legal definition of “financial needs” but also prevents regional variations in the interpretation.
