Clear Definition of “Financial Needs” Required

The Family Justice Council have been urged by the Ministry of Justice to act on recommendations previously outlined, which aim to clarify the law on financial needs following a divorce.

There has been significant confusion in relation to how one person should be required to meet the other’s financial needs after a relationship has broken down; whilst there have also been considerable regional variations.

However, the Ministry of Justice have suggested that the confusion surrounds the meaning of “needs” and the extent to which one spouse should be required to meet the other’s needs and for how long.

As such, the Ministry of Justice have called on the Family Justice Council to put forward guidance which not only defines and explains the legal definition of “financial needs” but also prevents regional variations in the interpretation.

Whilst calls have been made for guidance to be issued, for those currently going through a divorce who require legal advice in relation to divorce or financial matters, our solicitors in London can assist.
