Brain injury claim settled for over £3.5m against multiple hospitals
A man, represented by Paul Rumley, successfully sued 4 Defendants, (1) Barts Health NHS Trust in London; (2) Burton Hospitals NHS Foundation Trust; (3) Birmingham Children’s Hospital NHS Foundation Trust and (4) Great Ormond Street Hospital for Children NHS Foundation Trust in London, in an action for failure to diagnose his unusual cobalamin C deficiency condition.
Our client received a lump sum of £3,500,000 and lifelong annual payments of £66,500, for a delay in diagnosing and treating his cobalamin C deficiency.
As a result of the brain injury, our client was left severely cognitively impaired, was paraplegic, would always require carers and his life expectancy was reduced.
Very sadly, despite the claimant presenting to four separate hospitals over a long period of time with significant neurological symptoms, these were considered to be behavioural in nature and investigations failed to reach the correct diagnosis of a metabolic disorder and indeed only further worsened his condition. Over time his neurological damage deteriorated and became largely irreversible.
This was an extremely complex claim which demonstrated a clear need for hospitals in paediatric settings to be aware of a more unusual differential diagnosis, to undertake a full spectrum of testing and to refer onto specialist teams.
